General Terms for Service of Hotel Sentimento-Thassos

The following Terms and Conditions are valid for all contracts related to accommodation contracts

The following shall apply exclusively unless agreed otherwise with the customer/guest before the closing of the accommodation contract.

1. A contract is a written confirmation of service between hotel Sentimento Thassos and its executives, further referred to a “hotel” or “host” and a recipient of the service, further referred to as “guest” or “client”

2. Such a contract could only be formed between the aforementioned two parties. If a third party has made a booking on behalf of the client, those two would be considered jointly liable for any obligations arising from the contract.

3. The hotel is at all times obliged to provide the rooms, as booked by the client, as well as the agreed upon services.

4. The guest is obliged to pay the agreed prices to the hotel, including accommodation, additional services requested by the client and expenses paid by the hotel to third parties.

5. The agreed prices consist of the statutory value, including tax.This is to be applicable in a time period, previously agreed upon by the parties.

6. In the event of a change in prices after a reservation has been made, the amount that the guest is to pay shall remain as agreed upon in the contract.

7. The hotel shall make the reservation of every room binding with a payment of a deposit. The latter shall amount to 30% of the overall price
for the accommodation only, without additional fees for services. The deposit shall be paid as stated by the hotel, upon the conclusion of the contract.

8. The rest of the invoiced amount to be paid for the accommodation and for other services and goods is expected to be delivered at the time of the guest’s departure.

9. The hotel is entitled to require a full payment upon the conclusion of the contract in case of doubt about the client’s ability to pay.

10. In the event that the client fails to pay an invoice on the due date, they shall receive three reminders with a time limit, after which the hotel shall discontinue all current and future services.

11. The hotel shall be free to accept credit cards, unless otherwise indicated in the contract. Other online types of payments are only accepted on account of performance.

12. Debt waiver policy

1. A client's set off claims shall be recognized by the hotel if the righteousness is confirmed by declaratory judgment.
2. Any retention are only righteous when the hotel's claim and the clients counterclaim are based on the same contractual relationship.

13. Cancellation of contract

1. A written agreement between the parties shall only be canceled in the following cases:

1. If the deposit payment is not paid within the agreed period of five calendar days.
2. In the event of unforeseen circumstances, for which the hotel is not responsible.
3. Misleading or false information from the side of the client regarding their identity or the purpose of the stay.
4. If the hotel has a reason to assume that the use of the service will jeopardize the safety of other clients or other guests and or employees, the further operation of the business or the image of the hotel.
5. In the event that the client permits a third party to use the room and services, without the hotel administration's knowledge or consent (see number 14)

14. Use of the room.

1. Booked rooms are available after 3 p.m on the arrival date

2. Unless communicated otherwise, if the guest does not inhabit the room until 10 p.m., the hotel shall be allowed to give the booked room to another client. In that case, the former guest shall not have any claims against the hotel.
3. On the agreed upon departure date, the guest has to vacate the room by 11 a.m.
If that does not happen, the hotel may charge 50% of the full room price until 1 p.m. After that, the full price would be charged. This does not give the client permission to lay any contractual claims.
4. Any subletting or re-letting of the hotel room to a third party from the side of the client requires a written confirmation from the hotel administration.
If no such confirmation is present, the hotel may cancel any current and future services and bookings in the case of a sublease to a third party. This is also valid in the case of the unauthorized use of the hotel rooms for purposes other than accommodation.

15. Right of refusal

1. The hotel shall refuse access to the hotel to a client and refuse accommodation in the event that the client is under the strong influence of alcohol, drugs or is displaying abusive behavior towards other guest and/or staff members.
2. The hotel shall expel a client from the room without notice or refuse accommodation in the event that the latter is repeatedly harassing, disturbing the peace of or insulting other guests and/or staff members.

16. Liability

1. Hotel guests shall be allowed to park their vehicles on the hotel grounds. Nevertheless, the hotel does not carry any responsibility and would not be liable in the case of damage or lost belongings. An exception to that would be if any member of the hotel staff/administration has caused any damage due to negligence or intentionally.
2. The hotel shall not be liable for any objects or other personal belongings brought by the clients. Money and other valuables may be kept in the hotel safe. We recommend making use of this possibility
3. All claims against the hotel will always become statute-barred after twelve months from commencement. Damage claims are to be statute-barred after five years from commencement. This does not include life, body or health damages.

17. Final

1. All changes to the Terms and Conditions list must be made in writing.
2. Place of performance of the services shall be the hotel
3. Exclusive place of jurisdiction (e.g. for disputes over cheques and bills of exchange) shall be the administrative office of the hotel.
All negotiations shall be conducted in respect of commercial Greek law. The latter shall apply exclusively, together with the EU guidelines for such situations.
4. In the event that some of those Terms and Conditions become invalid, this would not affect the overall validity of the list. The invalid or unenforceable shall be replaced with valid and enforceable ones, where the latter comes as close as possible to the obsolete, invalid ones.
